Yet the discourse\ncontinues to haunt like a dise mbodied ghost. The discourse has\nworked itself out through a number of fa miliar dualisms: moral\nrights versus legal rights\, economic rights versu s human rights\,\ninstitutionalized rights versus right claims in praxis\, rights\nunder capitalism and socialism\, Eurocentric rights concepts vers us\nnon-Eurocentric rights\, the Asian values discourse or indigenous\ndis courses for example\, but whatever the starting point for the\ndiscourse o r the preferred theoretical framework\, attempts to\nground it in the mate riality of contemporary world order entangles\nthe discourse in conundrum of one type or the other. Yet\, if not\ngrounded in the materiality of con temporary world\, the Rights\ndiscourse loses its meaning as the very idea of Rights is tied\ninextricably with its sociality. Dr Radha D’Souza argu es that we\nface an acute poverty of philosophy amidst widespread poverty. The\nconnection between the two types of poverty is explored by\ninterrog ating the relationship between displacement and rights. She\nargues that i f we look further afield away from European\nphilosophical traditions we m ight be able to come to grips with the\npoverty of philosophy amidst pover ty. The Empire could not maintain these colonies after\nthe Second World War and left them in haste after arbitra rily\npartitioning them. The point of the panel is to look at\ncontemporar y border conflicts like Palestine\, Kashmir\, Pakistan\,\nand Sri Lanka wi thin a historical context.\n\nSpeakers:\n\nRadha D’Souza is a Reader in La w at the University of Westminster\,\nLondon. Her research interests inclu de global and social justice\,\nsocial movements\, Law and Development\, c olonialism and imperialism\,\nsocio-legal studies in the 'Third World' and water conflicts. She\nteaches Law and Development and has previously taug ht in Sociology\,\nDevelopment Studies\, Human Geography besides Public La w and Legal\nTheory. Earlier she practiced as barrister at the High Court of\nMumbai in India. Radha is a social justice activist from India\nwhere she worked in labour and democratic rights movements first as\norganizer a nd later as activist lawyer. Radha is a writer\, critic\nand commentator a nd has worked with solidarity movements in the\nAsia-Pacific region.\n\nMa zen Masri is currently a Ph.D candidate at Osgoode Hall Law\nSchool where he is also an instructor. Prior to resuming graduate\nstudies at Osgoode\, Mazen served as legal advisor to the\nNegotiations Affairs Department of the Palestine Liberation\nOrganization (PLO). He holds a Bachelor of Law d egree (LLB) from\nHebrew University and a Master of Law degree (LLM) from the\nUniversity of Toronto. Mazen's research interests include\nconstituti onal law and international human rights law.\n\nGuru Paran Gunaratnam hold s a Ph.D. in Comparative Literature from\nthe University of Toronto.
