 ments will be served.\nAbstract\nMexico's reform proposals regarding the a
 mparo action\n(an action alleging an infringement of fundamental rights an
 d\nfreedoms) aim to reconfigure the effects of rulings in amparo\ncases.\n
 Until now\, when judges hearing an amparo case have\nruled in favour of th
 e claimant\, the ruling has applied\nretroactively and with the aim of mak
 ing the wronged party whole.\nThe proposals\, however\, would be make it i
 mpossible to obtain a tax\nrefund for taxes paid on the basis of unconstit
 utional laws\,\ncontrary to the historically backward-looking and restorat
 ive\nnature of the amparo.\nIn this essay the author examines property dam
 age liability of\nthe government\, discussing its juridical nature and ana
 lyzing its\nconstitutional regulation within Mexico's legal framework.\nTh
 e author argues that the proposed reforms to the amparo will\nblock the ta
 xpayer who pays taxes under unconstitutional laws from\nrecovering her pay
 ment\, and thus it is important to consider\nwhether she can recover such 
 a payment under the head of\ngovernmental liability for property damage.\n
