  new legal regimen compromises\nthe rights of ordinary Americans more than
  most people realize\, the\nbrunt of the burden has been borne by Muslim a
 nd Arab men\,\nincluding American citizens.\nAs victims of antiterrorism e
 fforts have sought judicial review\nof these actions\, however\, the Ameri
 can courts have developed\nmyriad procedural excuses for avoiding hearing 
 challenges on their\nmerits:  the state secrets privilege\, the standing d
 octrine\,\nimmunity doctrines\, special pleading rules\, etc.\nJudges enga
 ged in this form of ab(ju)dication frequently argue\nthat it is properly t
 he job of the political branches to decide how\nantiterrorism efforts shou
 ld be conducted. Comparing treatment of\nthe claims of Canadian citizen Ma
 her Arar in Canada and the United\nStates raises serious questions about t
 he role of courts in\nchecking human rights violations\, and the need for 
 political\naccountability.\nAbout this annual conference\nThe Wallenberg C
